Short-Term Rental Eligibility on Maui

What every buyer should understand before purchasing a Maui condo for vacation rental use.

Please read first
The labels on this site are a research starting point. They describe the County record or the curated record that a listing matched, with the date of that record. They do not establish that any particular unit may be rented, today or in the future. Zoning, the lawful use history of the parcel, permits, the association's own documents and future changes in the law can all matter. Confirm the exact unit with the Maui County Department of Planning and a Hawaii real estate attorney before purchasing any property for short-term rental use. This page is informational only and is not legal advice.

What Is a Short-Term Rental (STR)?

On Maui, a transient vacation rental is the rental of a dwelling unit for fewer than 180 consecutive days. Maui County regulates that use through several separate mechanisms:

Bill 9 (2025), Ordinance 5909: the apartment-district phase-out

Maui County enacted Bill 9 (2025) as Ordinance 5909 on December 15, 2025. It removes transient vacation rental use from the A-1 and A-2 apartment districts after an amortization period that depends on the parcel's community plan area:

Community plan area Use must cease Notes
West Maui Community Plan area January 1, 2029 Amortization period ends December 31, 2028. On this site the area comes from the parcel's location in the County's Community Plan Areas map layer when our copy has that parcel, otherwise from the parcel's tax map key (the Lahaina tax district, TMK zone 4). It never comes from a postal city name.
All other areas of Maui County January 1, 2031 Amortization period ends December 31, 2030. Includes Kihei, Wailea, Makena, Maalaea and the rest of the County.
Hotel districts Not covered by this phase-out The ordinance addresses apartment-district use. Hotel zoning is a zoning record, not a promise about any unit, any association rule, any permit condition or any future law.

The ordinance includes exemptions and separate treatment for some uses. The County Council's Bill 9 overview states that timeshares, short-term rental homes permitted under Chapter 19.65 and bed and breakfast homes permitted under Chapter 19.64 are not affected. Whether an exemption applies to a specific unit is a property-specific question; this site does not decide it.

H-3 and H-4 hotel districts, and rezoning proposals

Ordinance 6008, in force since June 22, 2026, created the H-3 and H-4 hotel district categories. Creating a district category does not rezone any property. Moving a specific complex into one of those districts takes separate Council action on that parcel.

On September 23, 2026 the Maui Planning Commission voted 6 to 2 to recommend exemptions for only five properties among the dozens proposed in Resolutions 26-110 and 26-111. A Planning Commission recommendation does not bind the Council. As of early October 2026 no complex had been rezoned, and a recommended or proposed rezoning should never be read as an adopted one.

On this site, the label "Minatoya list, TIG Article 2" means a complex on the County list that the County's Temporary Investigative Group (TIG) Exhibit 2 recommended for rezoning to a hotel district. That is a recommendation. It does not change the complex's current zoning and it does not remove the phase-out date. The Article 1 and Article 2 distinction comes from the Hansen Ohana curated condo database, which records the TIG exhibit for each complex.

The Minatoya list

"Minatoya list" is the common name for the County's record of apartment-district properties with short-term occupancy use. The County publishes it as the Short-Term Occupancy List (the current PDF is dated June 27, 2024) and as a GIS parcel layer whose data was last edited on April 25, 2023. The County's own list states that inclusion does not confer any additional entitlement and directs readers to the Department of Planning to confirm a property's allowable use.

Short-Term Rental Home (STRH) permits, Chapter 19.65

The County issues STRH permits to qualifying properties under Maui County Code Chapter 19.65 and publishes a list of approved permits. On this site a listing whose parcel appears on our copy of that list shows the date of the list it came from. The permit's actual term and renewal status are not on the list, so this site does not estimate an expiration date. Confirm the permit with the County.

Source data and refresh dates

This site keeps its own copy of each County source below. Record date is the date the County gives the source (the layer's edit date or the list date). Last refreshed is when our copy last confirmed that source. A copy older than our 120-day refresh window is marked stale and listing panels say so. A stale mark does not change any record; it tells you to verify the record with the County.

How this site labels a listing

Each listing shows a Short-Term Rental Status panel with the record it matched, the source, and the evidence date of that record. The decision order is:

  1. Documented restriction: the complex is recorded as not allowing vacation rental use in our curated condo data (a human-verified entry, for example a complex that lost its status after the 2022 list). Not currently eligible
  2. Curated condo record: the Hansen Ohana condo database entry for the complex, including the TIG Article 1 or Article 2 exhibit and the recorded zoning. Eligible under current county policy, verify for this unit
  3. Hotel district zoning: the parcel is in a hotel district in the Hawaii Statewide parcel zoning layer. Eligible, zoning record
  4. Minatoya list: the parcel (or, failing that, the complex name) matches the County GIS layer. The phase-out date is taken from the parcel's community plan area. Eligible under current county policy, phase-out applies
  5. STRH permit: the parcel appears on our copy of the County's approved permit list. Eligible, verify the permit
  6. No record: nothing above matched. This is shown as Verification required. A missing record is not a prohibition and not a permission.

A timeshare interval in a listed complex is also shown as Verification required, without a phase-out date, because timeshare units are addressed separately under Ordinance 5909. Where a listing has no parcel tax map key, the panel shows both statutory dates and says the community plan area is unresolved rather than guessing one.

The evidence date on a panel is the date of the source record (for example the GIS layer's edit date or the permit list's date). Viewing a page does not refresh or re-review that record.

Legal challenges

Court challenges to Bill 9 have been reported in the news. This site does not track court dockets and makes no claim about the status or effect of any case. If litigation matters to your decision, ask a Hawaii real estate attorney for the current position.
